Landfill appeal date set

AN APPEAL by the Lyndhurst Landfill operator against a tribunal’s declaration that could stop it accepting hazardous waste will not be heard until February.
Last week, the Supreme Court in Melbourne heard SITA Envrionmental Solutions’ application for leave to appeal against a Victorian Civil and Administrative Tribunal (VCAT) declaration made earlier this year that the Lyndhurst Landfill was receiving hazardous wastes in breach of two council permits.
Members of action group Residents Against Toxic Waste in the South East (RATWISE) were present at the hearing to continue the group’s 14-year commitment to stopping the waste being dumped.
SITA was granted its leave to appeal and a date for the direction hearing in the Supreme Court was set as 23 February, 2007.
The news follows the City of Greater Dandenong council’s rejection this month of a permit amendment application by SITA and the EPA.
Mayor Peter Brown said council unanimously rejected the application.
Cr Brown said the relevant VCAT hearing would now have its enforcement order application jointly heard.
