A DANDENONG business underpaid a delivery truck driver who spoke limited English more than $124,000 over five years, the Fair Work Ombudsman will argue in court.
It will tell a directions hearing at the Federal Magistrates’ Court on 19 June that Lay Brothers (Wholesale) Pty Ltd paid the employee, an East Timorese immigrant in his 40s, between $10 and $11.50 an hour between January 2007 and December 2011 – even on weekends and when he was working more than 60 hours a week.
The Fair Work Ombudsman said he was entitled to at least $14 to $16 for normal hours and more than $20 an hour for overtime and weekends.
