A LOCAL McDonald’s restaurant is being sued for allegedly having a lack of security.
Peter, who does not want his surname used, was left with head injuries after an argument turned nasty in the Noble Park McDonald’s in December last year.
Peter, 44, commenced legal proceedings against McDonald’s in the County Court on Monday and is seeking unspecified compensation for pain and suffering, loss of wages and medical expenses.
The sickening attack, at 10pm on 3 December last year, was the result of a dispute over queue jumping which was taken outside.
Peter’s lawyer, Lee Flanagan of ArnoldThomas and Becker, said his client thought that was the end of it.
“But as my client was waiting for his meal, suddenly the assailant, Jason Josef, came at him and hit him twice with a marble bar,” Mr Flanagan said.
Josef was convicted for assault on Friday and sentenced to a 12-month intensive corrections order.
Peter returned to work as a plasterer in January but still suffers headaches, dizziness and post-traumatic stress.
Mr Flanagan said there was no security on that night.
“If there had been security this would not have happened,” Mr Flanagan said.
“Security would not have let someone in with a marble bar.”
A McDonald’s Australia spokesperson said if the matter was in court, the company was not in a position to comment.
