Family appeals for Sudan sentence

THE man who caused a boy’s foot to be amputated should be sent back to war-torn Sudan, says the boy’s family.
The family’s condemnation comes as the Supreme Court overruled a previous suspended sentence.
Taban William Gany crashed into Dandenong West Primary School in May last year and the County Court handed down a three-year suspended jail term in December.
The Director of Public Prosecutions lodged an appeal in March and last Friday the Supreme Court overruled the decision and said Gany would be sent to jail.
Gany was found to be more than three times the legal blood-alcohol limit after the crash.
He injured several children including Dandenong’s Sabi Mashid, then 6, who had to have his foot amputated.
This week his mother, Farid Mashid, said the family was still unhappy with Gany’s sentence and would not be content until the 33-year-old was sent back to war-torn Sudan.
“That sentence is nothing for him. Sabi’s life was ruined,” Mrs Mashid said.
“They should return him to the country he came from or else when he comes back from jail he might hurt others again.”
The Supreme Court sentenced Mr Gany to three years and six months’ jail with a minimum 21 months spent in prison before parole is considered.
Defence lawyer Lachlan Carter warned the Supreme Court’s intervention could lead to a double jeopardy situation where Gany was convicted of a crime already tried for.
But Supreme Court judge JJ Redlich said the original sentence was ‘manifestly inadequate’ and would damage public confidence in the justice system.
